These Terms govern your access to, and use of, all content, products, and services available at the Tiki Web Group, LLC website (the "Service") operated by Tiki Web Group, LLC ("us", "we", or "our").

Your access to our services is subject to your acceptance, without modification, of all of the terms and conditions contained herein and all other operating rules and policies published and that may be published from time to time by us.

Web Design and Development Services

Our services include but are not limited to website design, website development, content layout, website optimization, and ongoing website maintenance and support. Timelines for service delivery are estimates and may be subject to change. Payment terms will be outlined in a separate Service Agreement or proposal. We require timely access to client materials, existing website credentials (if applicable), and other information needed to perform our services effectively.

Intellectual Property

The Agreement does not transfer from us to you any of our or third-party intellectual property, and all right, title, and interest in and to such property will remain (as between the parties) solely with Tiki Web Group, LLC and its licensors. Any designs, layouts, code, strategies, or creative content developed by us remain our intellectual property until full payment for the services is received, at which point ownership may be transferred as specified in the applicable Service Agreement or proposal.

Third-Party Services

In using the Services, you may use third-party services, products, software, embeds, or applications developed by a third party ("Third-Party Services"), such as hosting providers, content management systems, analytics tools, or form processors. You understand that any use of a Third-Party Service is at your own risk, and we shall not be responsible or liable to anyone for Third-Party websites or Services.

Termination

We may terminate or suspend your access to all or any part of our Services at any time, with or without cause, with or without notice, effective immediately. Termination of a Service Agreement is subject to the conditions, including notice periods and final payments, outlined within that agreement or proposal.

Disclaimer

Our Services are provided on an "AS IS" and "AS AVAILABLE" basis. Tiki Web Group, LLC and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee specific business results or outcomes (e.g., specific levels of traffic, leads, or revenue) arising from the use of any website we design or develop.

Jurisdiction and Applicable Law

Except to the extent any applicable law provides otherwise, the Agreement and any access to or use of our Services will be governed by the laws of the State of Florida. The proper venue for any disputes arising out of or relating to the Agreement and any access to or use of our Services will be the state and federal courts located in Florida.
